Terms of Service

The short version

This site is mine, the training I write is mine, and using either means you agree to what is below. Training carries risk and you take it on knowingly. If you pay me for something, this explains what you are buying and what happens if you stop.

Who you are agreeing with

This site is run by me, Peter Tangel, trading as Precision Training, based in Peoria, Illinois.

Throughout these terms, "I" and "me" mean Peter Tangel and Precision Training. "The site" means ptxpt.com and its pages. By using the site you agree to these terms. If you do not agree with them, please do not use it.

Who can use this

You must be 18 or older to use this site, to buy anything from me, or to train with me.

What I offer, and which terms apply

Where a specific agreement covers a service, that agreement wins over these terms for that service.

Everything on this site is general information. It is not medical advice, not a diagnosis, and not a substitute for talking to a qualified professional. I am not a licensed healthcare provider and I am not a registered dietitian.

Training carries risk

Strength training and conditioning carry a real risk of injury. Before you follow anything I publish, read the disclaimer, talk to a medical professional, and take responsibility for your own safety, your equipment and your limits.

If you follow training from this site, you do so voluntarily and you accept that risk.

Your account

Some things need an account. Keep your login to yourself. You are responsible for what happens under it. Tell me if you think someone else has access.

Do not share, resell or give away access to anything you have paid for.

What you agree not to do

• Use the site for anything unlawful
• Interfere with how the site works, or try to break its security
• Scrape, copy or republish the content
• Post anything abusive, defamatory, obscene or deliberately harmful
• Pretend to be someone else

Paying me

Prices are shown at the point of sale and can change. A change never affects something you have already bought.

ADAPT is a monthly membership. It bills every month until you cancel, and you keep access until the end of the period you have paid for. Payment is handled by Stripe through AppRabbit, so I never see your card details.

Refunds. Because access is immediate, membership fees already paid are not refunded. Coaching and in-person training have their own terms, set out when you book. If something has genuinely gone wrong, email me and I will look at it properly rather than hide behind this paragraph.

Cancelling. You can cancel a membership at any time from the app. Cancelling stops the next payment. It does not refund the current period.

My work stays mine

The programming, writing, video, photography, design and branding on this site and in ADAPT are mine, or licensed to me.

Use them for your own training. Do not copy, republish, resell or redistribute them, and do not use them to run your own coaching business or to build a competing product.

Anything you post

If you send me a review, a comment or anything else for publication, you keep ownership of it. You give me permission to show, store and lightly edit it in connection with my business. You confirm it is yours to give and that it is not unlawful.

I can remove anything posted at my discretion.

What I do not promise

The site and its content are provided as they are. I do not promise the site will always be available, uninterrupted, error free, or that the information is complete or current at every moment.

I do not promise any particular result from following my training. Individual results vary, and they depend on things outside my control.

Limit on liability

To the fullest extent permitted by law, I am not liable for indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits or lost earnings, arising out of your use of this site or its content.

My total liability to you for any claim is limited to the amount you have paid me in the 12 months before the event giving rise to it.

Nothing here limits liability for gross negligence, willful misconduct, fraud, or anything else that cannot lawfully be limited.

Indemnity

You agree to cover me against claims, damages, losses and reasonable legal costs brought by a third party arising from your use of the site, your breach of these terms, or your infringement of someone else's rights, except where they arise from my gross negligence or willful misconduct.

Other sites

This site links to other places, including my YouTube, Instagram, LinkedIn and Facebook. I do not control them and I am not responsible for their content or practices. Going there is your own decision.

Ending access

I can suspend or end your access if you break these terms, misuse the site, or share paid access. Where it is reasonable to do so, I will tell you why.

You can stop using the site at any time.

Changes

I may update these terms. The current version is always on this page with its effective date. If a change is material I will make it obvious rather than slip it in. Continuing to use the site after a change means you accept it.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Illinois, and you agree to those courts having jurisdiction.

If any part of these terms is found unenforceable, that part is removed and the rest still applies.
